The parties agree as follows:

* All images included herein are intended for distribution exclusively to consenting adults in locations where the images do not violate any community standards or any federal, state or local laws or regulations of the United States or any other country. No person under the age of eighteen years of age may directly or indirectly view or possess any of the contents hereof. Purchaser acknowledges that the materials contain explicit visual, audio and/or textual depictions of nudity in situations of a sexual nature, and that you are familiar with such materials and that you are not offended by them. Purchaser represents and warrants that Purchaser is currently over the age of eighteen years and are capable of lawfully entering into this Agreement.
* Purchaser acknowledges and agrees that all materials contained herein are proprietary and constitute valuable intellectual
property. The copyrights are owned by PixMasters and are protected under the Copyright Act of the United States (Title 17 of the U.S. Code) and various foreign and international copyright laws. Any use of the materials in violation of this Agreement will constitute copyright infringement and will be a breach of the Copyright Act of the United States and the copyright laws of all signatories to the Berne Copyright Convention and the Universal Copyright Convention.
* Subject to the terms and conditions set forth herein, PixMasters hereby grants to you a limited non-exclusive and non-transferable license to use the images on all web sites this includes but not limited to the use on Pay, Free, AVS, TGP, or any other type of site where adult material is allowed. All web sites that these images are used on must show Purchaser's name within the publicly accessible records of the InterNIC or other registration agency. If the name is not registered with InterNIC or other registration agency, the name of the Purchaser must be easily found on each web site. Any transfer of rights hereunder requires PixMasters's prior written permission.
* Purchaser will not offer PixMasters's images for sale nor license or trade them in any way whatsoever including but not limited to bartering or selling free images in return for traffic, sign up commissions, advertising revenue, or the like Unless used in the Betabrigade program. The Purchaser will not knowingly allow other webmasters to use the images, other than as set forth within this Agreement.
* Purchaser may post up to five (5%) images from this image set in newsgroups, as often as Purchaser desires as long as the same five (5%) images are used each time. It is strictly forbidden to post this entire image set on one or several newsgroups or to use different groups of five (5%) images from the image set on different postings. Doing so will result in termination of this license without refund.

* Purchaser may resize, resample and rename the image files and manipulate and/or crop up to (5%) images from this set for constructing advertising banners for the web site.
* Purchaser has 14 business days to fill out the requested information in this licensing agreement and to return it to PixMasters. All licensing rights to the images are conditioned on the receipt by PixMasters of a duly acknowledged licensing agreement which has been received by PixMasters within 14 business days and the receipt of full payment. Purchaser may use the pictures immediately on the aforementioned web site, as long as the 14 day grace period is not exceeded. Failure to submit the licensing agreement included with each image set within 14 business days of purchase and failure to make payment in full, or the submission of false or misleading information will nullify this Licensing Agreement and result in the immediate forfeiture of rights hereunder to use the images without refund.
This Agreement shall be governed by the laws of the State of Colorado, United States of America. Purchaser will indemnify and hold PixMasters harmless from any legal matters relating to the distribution of the material as it relates to the community standards and adult entertainment laws as set forth in the city/county, state, province or country of Purchaser and their web sites. PixMasters does not warrant this material to be acceptable in your community and Purchaser assumes full responsibility for determining what images are suitable for distribution. PixMasters warrants the images were produced in compliance with provisions of Title 18 of the United States Code § 2257.
